Welcome to Soupologie.com. Access to this site is in accordance with these Conditions and by using and subsequently ordering from this site, you are agreeing to these Terms & Conditions. We have the right to revise and amend these terms and conditions at any time and without prior notice to you. We will post any changes here and you should check them prior to using this site.

1.1 You are not permitted to download any part of our site (other than by reason of automatic page caching), to amend or modify it or any part of it, to reproduce or copy, sell (including any resale), or otherwise exploit our website (or any part of it) for any purpose. Nor are you permitted to frame our website or to link to any element of it other than the homepage.

1.2 You may link to our homepage, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice.

We shall not be responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non-performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods.

Your Data

4.1 By signing up to Soupologie.com you are certifying that the information you provide upon registration is true, accurate, current and complete in all respects. Further to this by placing an order with us you are confirming you are the authorized user of the credit or debit card and there are sufficient funds to cover the cost of goods and services. If any information is deemed incorrect, misleading, or if we suspect fraud, we reserve the right to cancel your membership at any time and without prior warning.

4.2 All account information and passwords are non-transferable and are to be used only by the account holder. You as the account holder are responsible for ensuring your account details are secure and as such your account cannot be violated or misused in any way.

4.3 We respect your personal data and as a responsible retailer comply with applicable UK Data Protection legislation. However, you should be aware that if we are requested to provide information pertaining to your activities on this site to the police, or any other regulatory or government authority, or by court order we shall do so.

4.4 By placing an order you authorize us to transmit information or to obtain information about you from third parties where necessary. This includes but is not limited to your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorize individual purchase transactions.

4.5 We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Price & Payment

5.1 All prices are in £ sterling and are inclusive of VAT (where applicable) at the current rate. The total cost of your order is the price of the products plus delivery charges. For more information on our delivery charges please see our delivery page.

5.2 Payment can be made by Visa, MasterCard, Maestro, Visa Electron, Solo and PayPal. Payment will be debited and cleared from your account prior to dispatch.

5.3 By placing an order you confirm the credit/debit card used is yours. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer does not authorise the transaction, for any reason, we will not be liable for any delay or non-delivery.

Availability & Delivery

6.1 All items are subject to stock availability. Whilst we endeavour to keep stock levels as accurate as possible, where there is the possibility of human error or system malfunction we cannot be responsible for incorrect stock levels or subsequent unfulfilled orders.

6.2 We make every effort to deliver goods on the day we specify, however, we cannot guarantee delivery on that day or accept liability for deliveries made outside this timescale.

6.3 Orders placed outside operational hours stated in the deliveries page cannot be dealt with until the following day.

6.4 Orders within the European Union, Russia, America or the rest of the world are subject to restriction on Packaging sizing and Weight. This is enforced by our courier services within the UK. Packages cannot weigh more than 2kg and the Width, Height and Depth combined cannot equal no more than 900mm. We will try our best to ship your order, but on occasions additional charges may apply.

Acceptance of your order

7.1 Display of goods on Soupologie.com is on an invitation to treat basis and is not an offer to sell goods or services at any price indicated. Once an order has been placed confirmation and dispatch emails will be sent respectively. Neither of these emails constitute acceptance of the order by us. Your order will be accepted by us only when we dispatch the goods to you.

7.2 Whilst we make every effort to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error once an order has been submitted we will contact you with the correct information. You may then choose to cancel your order or re-confirm it with the new details. If we are unable to contact you we will treat your order as cancelled.

7.3 We take care to ensure all details, images & product descriptions are correct at the time of adding them onto the website. However, we cannot be held responsible for small changes in description or guarantee the accuracy of all images on this website. Colours of actual products may differ from those in the images and this is an unavoidable result of our photographic process.

7.4 Other reasons an order may be cancelled are unavailable stock or our inability to obtain authorization for your payment. We reserve the right to cancel your order under any of these circumstances.
